  • Help reduce the risk of COVID-19 infections at YOUR IT Expert premises.

COVID-19 Screening Tool and Thermal Vision Camera

In order to help reduce the risk of COVID-19 infections and keep our communities safe, all YOUR IT Expert employees, contingent workers, and visitors must complete a daily health survey and pass a thermal body temperature screening in order to gain access to YOUR IT Expert premises. The thermal vision camera measures your body temperature on an anonymous basis and YOUR IT Expert does not retain your body temperature. If your body temperature is equal to or above 100 degrees Fahrenheit, you will be denied entry and/or asked to leave YOUR IT Expert premises.

The health survey screening tool, available via an app or web portal, collects your name, email address, and certain health data you voluntarily provide. This information will be retained on your device and not shared with YOUR IT Expert unless you self-report that you are COVID-19 positive. In that case, the tool will notify YOUR IT Expert Environment, Health, and Safety (“EHS”) team, and your email address will be retained for up to 30 days (subject to local laws) so EHS may contact you as it takes appropriate action to protect the health and safety of individuals at YOUR IT Expert physical locations. Your COVID-19 positive status will be shared with the YOUR IT Expert EHS team and applicable public health authorities (as required by law). Your status will also be shared on an anonymous basis with potentially infected individuals for contact tracing purposes.

Your Data Principal Rights

You may have the following data principal rights under applicable Indian data privacy laws:

  • Right to Access: you have the right to access your data to confirm whether we process your personal information, how we process your personal information and to obtain a copy of that personal information.
  • Right to Correction: you have the right to request the correction of inaccurate or misleading personal information, completing the incomplete personal information, or updating the out-of-date personal information about you.
  • Right to Deletion: you have the right to request deletion of your personal information that we collected about you.
  • Right to Portability: you have the right to receive your personal information, in a structured, commonly used, and machine-readable format and to have that information transmitted to another organization in certain circumstances.
  • Right to withdraw consent: you have the right to withdraw your consent to process your Personal Information that you have provided to us.

  • Click “unsubscribe” in any email marketing communications we send you.
  • Go to your MyAccount or visit our Preference Management Center to select your marketing communication choices.
  • Go to our List Removal Page to be removed from receiving marketing-related communications.
  • Please be aware that it may take up to 10 business days for your email preferences to take effect.

Overseas Transfers

We may transfer your Personal Information to our other companies and to our affiliated companies, and/or to our Business Partners as permitted by law if required for the purposes described in this Privacy Statement. This may involve the transfer of your personal information to countries outside of India. Such countries may include, without limitation, the Asia Pacific, UK & Europe, United States & Canada etc and other countries in which NewGen IT or its affiliates or Business Partners doing business. We will take reasonable steps to ensure that the overseas recipient do not breach applicable Indian Privacy Laws in relation to the information or obtain your consent to such cross-border data transfer, or if any exceptions apply under applicable laws and regulations. We have in place contractual arrangements (as appropriate) with our affiliates and Business Partners in respect of such transfers. We will take all reasonable technical and organizational measures to safeguard Personal Information we transfer.

We understand the importance of taking extra precautions to protect the privacy and safety of children using our products, services, and our websites. Children under the age of 13 or equivalent minimum age in the relevant jurisdiction, must not share their personal information unless their parent or guardian provided verifiable consent. Any violation of these restrictions may result in a copyright, trademark, or other intellectual property right infringement that may subject you to civil and/or criminal penalties. Other marks on the site not owned by Your IT Expert may be under license from the trademark owner thereof, in which case such license is for the exclusive benefit and use of Your IT Expert unless otherwise stated, or may be the property of their respective owners. You may not use any of the trademark name, logos, trademarks or brands, or trademarks or brands of others on the Site without Your IT Expert express permission.

Your IT Expert Services and Third Party Services and Sites

The information and materials provided in the Site and through the Services are intended for general reference only, and may not describe all of the terms, conditions, and exceptions applicable to Your IT Expert Services. Privacy and Passwords

Your IT Expert values and protects the privacy of your information. Please review the Your IT Expert privacy policy, as it contains important information relating to your use of the Site and Services. Some portions of the Site are protected and require a user identification code (“User ID”) and password for access. Unauthorized access or use of such portions of the Site is prohibited. You agree that you will notify Your IT Expert immediately if you believe that a third party has obtained your User ID or password, or if you believe that any unauthorized access or use may occur or has occurred. For your protection, if Your IT Expert believes that any unauthorized access may occur or has occurred, Your IT Expert may terminate access without prior notice to you. Membership

a. Registration and Basic Membership Terms: Members are visitors to the site and or those using the Services that choose to register with Your IT Expert (“Members”). Once registered, an account is created for each Member (“Account”). If you choose to register as a Member, you represent and warrant to us that:

(i) you are of legal age to form a binding contract

(ii) you will provide us with accurate, current and complete registration and contact information, and keep your information updated

(iii) your registration and your use of the Services are not prohibited by law. We reserve the right to suspend or terminate your membership, or your access to the Site and or Services, in the event that you breach any of the Terms & Conditions or other applicable Your IT Expert policies.

b. Password and Account Security: In connection with your Account, you will create a password and a user id. You are responsible for keeping your password and secure, and you are responsible for all actions taken using your password.

c. Age: To create an Account or to otherwise use this Website, you must be at least eighteen (18) years old or the age of majority in your state or province of residence, whichever is greater.

Inactive Accounts

a. Inactive Status: A Member’s Account may be set to inactive if there is no activity associated with that Account for 180 days.

Warranty Exclusions and Limitations of Liability

We warrant that the Services and Your IT Expert Property will conform substantially to the descriptions set forth on the Site. In the event of any breach of this warranty, the Customer’s sole and exclusive remedy, and Your IT Expert sole and exclusive liability, shall be (at Your IT Expert option) to remedy the failure or to refund the monetary amount paid for the services by the Customer, if any. Except as set forth in the foregoing sentence, we make no representations or warranties of any kind regarding the Services or the Your IT Expert Property. We expressly disclaim any and all warranties, whether express or implied, including: all warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any and all warranties arising from course of dealing and usage of trade; that the services and Your IT Expert property will meet your requirements, will always be available, accessible, uninterrupted, timely, secure or operate without error, as to the results that may be obtained from the operation, use or other exploitation of the services or Your IT Expert property, and as to the accuracy or reliability of any information obtained from the services or the Your IT Expert property. No advice or information, whether oral or written, obtained not expressly stated herein. Under no circumstances will you be entitled to recover from us any incidental, consequential, indirect, punitive or special damages (including damages for loss of business, loss of profits or loss of use), whether based on contract, tort (including negligence), or otherwise arising from or relating to the services or Your IT Expert property, even if Your IT Expert has been informed or should have known of the possibility of such damages. in any event, Your IT Expert maximum aggregate liability for any and all damages arising from the services or the Your IT Expert property shall be a refund of the amount paid by you to us, if any. Indemnity

Customer agrees to indemnify and hold Your IT Expert, our affiliates, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party due to or arising out of (i) your access to or use of Services, (ii) your violation of these Terms & Conditions, or (iii) the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity. Your IT Expert reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Your IT Expert. We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

Applicable Law, Jurisdiction, Compliance

You and Your IT Expert agree that all matters arising from or relating to the use and operation of the Site and/or the Services will be governed by the substantive laws of Republic of India, without regard to its conflicts of laws principles. You agree that all claims you may have arising from or relating to the operation, use or other exploitation of the Site and/or the Services will be heard and resolved in the courts located in New Delhi. You consent to the personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceeding in such courts, and covenant not to assert any objection to proceeding in such courts.

We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect.
